Planning Board hearings continue with return of Borough Engineer Haack

The Planning Board hearings on West Brook Hills II continued on July 14th with Borough Engineer Ed Haack giving his long-anticipated report on the development. In his report, he maintained his long-held position that all of the lots met the boroughís average slope requirement of 20%. (CLEAN staff and volunteers had already provided documentation showing that nine lots had slopes in excess of 20%).  Haack dug in his heels and contested CLEANís figures, even though he provided no backup from the developer or himself. Planning Board member Brad Wiley asked for further documentation from the developer, who agreed to provide it for only the lots in question at the next hearing.

Another point of contention was the agreement struck between North Jersey District Water Supply Commission and the developer. Mr. Haack contended that the agreement rendered the matter ëclosedí, stating that there was no need for in depth discussion on the matter. But residents and CLEAN disagreed, asking to see details of the agreement, which will adequately protect the water supply according to Haack.

The applicantís engineer had been asked at the prior hearing to provide new stormwater calculations, showing that there would be no additional stormwater runoff caused by the new development. However, these calculations were not provided.

The hearings were not concluded, so they were re-scheduled for July 28th. However, neither CLEANís attorney Michael Kates, nor our expert, John Thonet were available for the hearing. CLEANís attorney submitted a formal request to have the hearing postponed until September, when both professionals would be available. But Planning Board Attorney Shep Peck denied the request.
